“IT’S A MOO POINT!” DOJ WHINES TO COURT THAT SLUSH FUND INJUNCTION IS IMPROPER BECAUSE THEY PINKY-SWORE NOT TO DO IT

(“Moo” is not a typo, it’s a dog-whistle – well, cow-whistle, to all of my fellow Friends fans – you know who you are, and you know who said it. :~) )
You may recall that last week I told you that a Federal court had enjoined the administration from moving forward with Trump’s $1.776billion slush fund, including from transferring funds in or out of it, until the Court could be fully briefed on and rule on the situation. That case was ‘Floyd’, which was filed in Virginia. A second case, Citizens for Responsibility and Ethics in Washington, or ‘CREW’ was filed at around the same time in D.C., and they are asking for an injunction against the slush fund as well.
Yesterday the DOJ filed their opposition to the injunctions in both cases. Their primary argument in their Memorandum in Opposition (included for Notes from the Front members) is that the whole thing has been rendered moot because Todd Blanche told Congress that they were no longer pursuing the slush fund.
JUST WHAT KIND OF GAME IS THE DOJ PLAYING?
If you aren’t planning to move forward with it, then why do you care if there is an injunction enjoining you from moving forward with it?
Or, in terms that a 3-year-old can understand, if you don’t plan to do something then why are you so b*tt-hurt that you’re being told not to do it?
The reality can only be that they don’t want that injunction hanging out there because they *might* decide to do it after all at some point in the future, and they don’t want a pesky little thing like a court order saying that they can’t to stop them.
But they are really hammering it home, pointing at least three times to Blanche’s telling Congress that:
“The Acting Attorney General’s statements to Congress make it “absolutely clear the allegedly wrongful behavior could not reasonably be expected to recur.” ”
and:
“On June 2, 2026, the Acting Attorney General told Congress that although “the reasons for the Fund remain important,” the Fund is “not going forward, period.” ”
and more fully:
“On June 2, 2026, the Acting Attorney General testified at a congressional hearing:
A: “. . . We’re not moving forward with the Fund . . . We are not moving forward with the Fund, period. . . . The reasons for the Fund remain as important as they were before, but we are not moving forward with the Fund.”
Q: “Not moving forward ever?”
A: “Correct.” ”
Of course, he had his fingers crossed behind his back.
Without that injunction all that has to happen here for them to re-animate that slush-fund is for it to be reassigned out from under Blanche so that he has plausible deniability (“I meant it when I said it, now it’s out of my control.”)
They put forth other arguments in their 28-page whine (included for Notes from the Front members), but the the argument for mootness is… well… I have another question, along with what kind of game are they playing:
