I HAVE THE CRIMINAL COMPLAINT AGAINST COLE ALLEN AND HIS FULL ‘MANIFESTO’ – HERE’S WHY I THINK HE COULD BEAT THE “ATTEMPTED ASSASSINATION OF TRUMP” CHARGE
I now have the criminal complaint that was filed against Cole Allen in the White House Correspondents’ Association Dinner attack, which complaint includes an affidavit by an FBI agent. I also have a copy of Allen’s full email which people are calling his “manifesto”. (Why do the targets and the media *always* call these things a manifesto? The dictionary defines “manifesto” as ‘a public declaration of policy and aims’. It’s from the Latin ‘manifestare’ which literally means “to make public”. This was not public at all – it was a private email to a few of his family members and someone he worked with. The only reason it’s ‘public’ now is because one of the recipients of that private email shared it.)
Anyways, the criminal complaint charges him with three offenses:
1. Attempting to Assassinate the President of the United States
2. Transportation of a Firearm & Ammunition in Interstate
Commerce with Intent to Commit a Felony
3. Discharge of a Firearm during a Crime of Violence
(By the way, EVERYBODY is misleadingly saying that he took a train from Los Angeles to Chicago, and then he took a train from Chicago to Washington D.C., as if those were two separate trips that he booked. In order to go from the west coast to the east coast on Amtrak you *have* to change trains in Chicago, it’s the point at which the various routes converge; there is no single-train route from one coast to the other. You switch trains in Chicago.)
Now, I am *not* a criminal attorney, but I am a litigator, and my time in the trenches in specialized family law made my law practice ‘criminal adjacent’. And I believe that a good defense attorney may be able to dispense with the “Attempting to Assassinate the President of the United States” charge.
Because at *no* time does Allen say in his email that he wants to assassinate Trump. What he says in that email (full text included for Notes from the Front members, along with the complaint and FBI affidavit), is that his targets are, and I quote:
“Administration officials (not including Mr. Patel): they are targets, prioritized from highest-ranking to lowest.”
(Are you as curious as am I as to *why* he exempted Kash Patel?)
Now, there are a few different definitions of “administrative official”; they all are some version of someone that is either hired or appointed to work for a particular unit of government. Not *one single* definition of ‘administrative official’ which I could find includes “elected”. It’s all either hired or appointed.
Remember, the government has the burden of proof to *prove* that Allen intended to assassinate Trump.
Oh, but you may be thinking, surely there are other things in that email that say “Trump”.
FIrst, the name Trump doesn’t appear in there at all. Nor does the term “president”.
In fact nothing refers to Trump directly *unless* they are willing to say he is referring to Trump where he says “I am no longer willing to permit a pedophile, rapist, and traitor to coat my hands with his crimes.”
Now, you see, you may accuse me of splitting hairs, but remember, I have an advanced degree (a doctorate in fact) in splitting hairs. So, that’s Dr. Hair Splitter to you.
This is what lawyers *do*. And, again, the government has the burden of proof to *prove* that he intended to kill Trump.
In fact, I believe that a really good defense lawyer (should we start a GoFundMe?) may be able to prove that he didn’t intend to *kill* anyone at all! Because he *also* says:
“In order to minimize casualties I will also be using buckshot rather than slugs (less penetration through walls)”
What kind of deranged killer tries to minimize casualties? I would argue, were I his lawyer, that he only intended to scare people, or, at worst, maim them.
So, yeah, I think that, while he’s going to do a looooong time in a Federal Pen, I think he may beat the most serious of those charges, trying to assassinate the president.
