I HAVE SO MANY MIXED FEELINGS ABOUT THIS! JOHN EASTMAN DISBARRED (DOCUMENTS INCLUDED)
Colour me ambivalent. The moment that I heard the news that John Eastman had been disbarred my first thought was “Yes!!!”
And then “Damn I’m proud to be a member of the California State Bar!” (The California bar decision disbarring Eastman is included for Notes from the Front members)
But my very next though, which followed on so fast that it collided with the first thoughts, and immediately deflated them, was “Dammit. WHY does it have to be a lawyer? I hate it when a fellow lawyer (and in this case also a fellow law professor) so thoroughly turns to the dark side.”
Like I often joke, 98% of the lawyers out there…
… make the other 2% of us look bad.
But I say that in jest, because the vast, and I do mean *vast* majority of the people who go to law school do so intending to use their powers for good. Take it from me, I know, because I had a whole lot of them as students.
But a few of them do turn to the dark side.
And so it was with John Eastman.
You may recall that Eastman was one of the people who encouraged Trump to try to steal the 2020 election by contriving to use a fake (for which their code word was “alternate”) slate of electors. His misbegotten theory was that Vice President Pence had the unilateral authority to *reject* the votes of the legitimate electors, and to instead substitute the votes of an “alternate” slate of electors. Thank goodness VP Pence stood firm, even in the face of unimaginable pressure, including being hung in effigy. He didn’t leave the building, as he could have, instead he hunkered down in the basement until the all clear, and then went on to *certify the actual elector votes*, thus certifying that Biden had been elected.
Anyways, Eastman, along with several others, has been charged with felony counts in Arizona (where he had pressured some election officials to support the fake electors), including:
Conspiracy to commit filing false documents
Conspiracy to commit filing false documents
Filing false documents
Solicitation of violation of oath by public officer
Conspiracy to commit impersonating a public officer
Conspiracy to commit forgery in the first degree
Conspiracy to commit false statements and writings
(There was also a case in Georgia, which has since been dropped.)
In fact, one of his co-conspirators charged in Arizona is Rudy Giuliani, who was disbarred by the State of New York in July of 2024, and by D.C. in September of 2024. A non-charged co-conspirator lawyer, Kenneth Chesebro, was also disbarred by New York in June of 2025. In addition, Jenna Ellis, another lawyer who worked to help try to steal the 2020 election for Trump, was suspended in 2024 for 3 years by the Bar of Colorado.
So this should be both a cautionary tale for lawyers, and an encouraging tale for the American people: in the words of Dr. Martin Luther King, “The arc of the moral universe is long, but it bends towards justice.”
Or, in the words of me: you can run, but you can’t hide, and we’re *going* to get you one way or another.
Also, play stupid games, win stupid prizes.
