WHOMP, WHOMP, WHOMPITY, WHOMP! “UNCLE”! COURT ORDERS FEMA TO CEASE IMPOSING DEI RULES FOR DISASTER GRANTS, FEMA COMPLIES
by Anne P. Mitchell, Esq. – attorney, law professor emeritus, and author of Federal law
This past month, in a lawsuit brought by the city of Salem, Oregon against FEMA, DHS, and Markwayne Mullin, over the administration’s imposition of conditions – in order to apply for a *disaster* grant! – *prohibiting* any DEI or gender-affirming promotion, and *requiring* adherence to completely unrelated executive orders, the Court *enjoined* FEMA, et al, from requiring those conditions, and *ordered* FEMA to confirm to the Court that:
“Defendants shall serve and file a declaration(s) verifying that (a) Plaintiff is not subject to the Challenged Conditions; and (b) they have complied with this Order.”
Last week one Vincent J. Maykovich, Regional Administrator (Acting), Federal Emergency Management Agency, did exactly that, filing a declaration, under penalty of perjury, confirming, among other things, that:
“Defendants will not enforce the Challenged Conditions as to Plaintiff on any grants subject to this lawsuit; 3) Defendants will not require Plaintiff to certify compliance with the Challenged Conditions; and 4) Defendants will not refuse to issue, process, sign grants agreements or retaliate in any way based on Plaintiff’s participation in this lawsuit.”
I thought you guys might like to see for yourself what the administration’s capitulation looks like.
Remember, of the over *500* lawsuits against this administration since January 2025, the *vast*, and I do mean *vast*, majority of them have gone against the administration.

P.S. If you actually read all the way to the bottom please leave a sentence in a comment that includes the word “baloney”. It will show me that my efforts aren’t in vain and that people actually *do* read these things, and it will drive those who just skim crazy wondering just why everyone is talking about baloney! ;~)
