So Alejandro Brito, et al, have appealed Judge Williams’ sanctions and other actions against them in the (I’m) Trump v. (and I’m also the) IRS case. I thought you guys might like to see what they claim are the issues – I’m taking this directly from the form that they had to fill out to file the appeal, the “Civil Appeal Statement”:
“1) Whether the district court incorrectly concluded that the President and the Executive branch are “one,” and cannot be adverse, where the court improperly ignored that the President sued for recovery in his personal capacity.
{Note from Anne: Of course they ignore entirely the whole “Trump’s DOJ *failed to defend the IRS* against that “I’m just a person” plaintiff, which of course was because *he’s actually the president*.}
(2) Whether erroneous sua sponte sanctions lacked adequate notice, evidence, and individualized findings.
(3) Whether the improper gag order is an unconstitutional prior restraint exceeding the district court’s authority.”
