HOLY F$&#!!! I JUST FOUND THE DOJ’S INVESTIGATION OF ACOSTA’S HANDLING OF THE EPSTEIN INVESTIGATION, INTERACTIONS WITH VICTIMS, AND THE NON-PROSECUTION AGREEMENT!!

by Anne P. Mitchell, Esq. – objective, fact-based reporting of what’s going on in the legal system with this administration

I just found both a 13-page executive summary, and a *290*-page full report of the DOJ’s 2020 investigation into how Acosta and others handled the Florida Epstein matter, the NPA, and communications with the victims (really lack thereof), both files are included for Notes from the Front members.

The lead up to all of this was that originally the Palm Beach Police Department (PBPD) in Palm Beach, Florida, arrested Epstein. The case was given to the state attorney’s office which led to a grand jury indictment. But PBPD felt that the state wasn’t handling the case with the appropriate gravitas, and so the *PBPD* contacted the FBI.

Then, as both the Summary and the Report explain:

“The FBI brought the matter to an Assistant U.S. Attorney (AUSA), who opened a file with her supervisor’s approval and with the knowledge of then U.S. Attorney R. Alexander Acosta. She worked with two FBI case agents to develop a federal case against Epstein and, in the course of the investigation, they discovered additional victims. In May 2007, the AUSA submitted to her supervisors a draft 60-count indictment outlining charges against Epstein. She also provided a lengthy memorandum summarizing the evidence she had assembled in support of the charges and addressing the legal issues related to the proposed charges.”

Then, of course, the notorious NPA happened, in which the Feds backed off prosecuting, and let the state of Florida do it.

The Report had two basic issues which it was looking at:

1. What was up with that NPA???

2. WHY weren’t the victims consulted about the NPA??

Now, because this is an investigation by the Office of Professional Responsibility, what they are ultimately looking for is whether Acosta and any of the U.S. attorneys working under him committed professional misconduct. And while they found that *technically* Acosta did not, the Report DID find, and call out, his actions *and* inactions!

“Although Acosta’s decision was within his authority and did not constitute professional misconduct, OPR concludes that Acosta exercised poor judgment when he failed to make certain that the state intended to and would notify victims identified through the federal investigation about the state plea hearing. His decision left victims uninformed about an important proceeding that resolved the federal investigation, an investigation about which the USAO had communicated with victims for months. It also ultimately created the misimpression that the Department intentionally sought to silence the victims. Acosta failed to ensure that victims were made aware of a court proceeding that was related to their own cases, and thus he failed to ensure that victims were treated with forthrightness and dignity.”

Of course there is waaaaay more, again it’s a 290-page report (and also again, I’m also including the 13-page executive summary).

IMPORTANT: Notes from the Front members, do NOT share these documents publicly! It will become immediately obvious why when you open the Report. While it’s ok for you to have it, it would *not* be ok to post it publicly.

P.S. If you actually read all the way to the bottom please leave a comment that includes the word “inaction”. It will show me that my efforts aren’t in vain and that people actually *do* read these things, and it will drive those who just skim crazy wondering just why everyone is talking about inactions! ;~)
