BREAKING! 10 NAMED VICTIMS PLUS 1 JANE DOE SUE LES WEXNER FOR ENABLING AND PROVIDING SUPPORT TO JEFFREY EPSTEIN
In a stunning move, ten named victims, along with one Jane Doe, have sued Leslie Wexner, and for an amount that “exceeds the jurisdiction of all lower courts which would otherwise have jurisdiction.”
The reason they say that about the amount and jurisdiction is because the amount they will be seeking exceeds the limits allowed by the trial courts in New York (trial courts have amount limits just like small claims courts do), and so the case was “removed” from having been filed with the trial court in New York, and filed *directly* with the Federal District Court (SDNY, where, as it happens, the judges already have *lots* of experience with Epstein lawsuits). This is why, even though the case was initially filed earlier this month (at the trial court level), it was only filed for realsies this Monday.
While I’m talking about the New York courts, it’s also important to understand that the trial court in New York is confusingly called “The Supreme Court of the State of New York”. Thanks, New York!
Back to the lawsuit against Wexner. Wow do they come out of the gate loaded for bear – or, in this case – loaded for Les.
They OPEN with a quote from Congressman Robert Garcia, quoting what he said following the deposition of Wexner in February (so note how quickly they pulled this lawsuit together after that):
“We should be very clear that there would be no Epstein island, there would be no Epstein plane, there would be no money to traffic women and girls, Mr. Epstein would not be the wealthy man he was without the support of Les Wexner.”
Then they go on to explain *exactly* what that means in more than 100 numbered paragraphs, the first three saying:
“1. There would be no Epstein without Les Wexner. Congressman Garcia is right.
2. Defendants LESLIE H. WEXNER, along with defendants NINE EAST 71ST STREET CORPORATION and THE WEXNER FOUNDATION, both entities created, managed and/or controlled by Defendant LESLIE H. WEXNER, enabled Jeffrey Edward Epstein (“Epstein”) to build an international sex trafficking ring and to commit heinous acts of gender-motivated violence against Plaintiffs.
3. Here’s how the enabling worked: defendant LESLIE H. WEXNER gave Epstein approximately $200 million or more over the course of twenty years that Epstein used to build his sex trafficking network and commit acts of gender-motivated violence against Plaintiffs, and other women and children.”
Now, as you read this complaint (included for Notes from the Front members) you will see many references to “gender-motivated violence”. That is necessary to cite because they are filing this under, at least in part, New York City’s Gender-Motivated Violence Act (GMVA) which allows victims to sue *both* individuals *and* institutions for their role in gender-motivated violence. And this is why they can sue and are suing Wexner both individually, and his organizations. Also, if you don’t want to read about the actual abuse, you can skip paragraphs 54-62, and you should be fairly safe. That said, there are not especially graphic descriptions, each plaintiff is alleging “gender-motivated violence”, not going into details.
They also include a couple of snippets of transcripts, and photos of Epstein and Wexner together in social situations.
The victims are asking for a jury trial and “such sums as a jury would find fair, just, and adequate,” and also “punitive and exemplary damages from defendants in such sums as a jury would find fair, just, and appropriate to deter said defendants and other from future similar misconduct.”
I predict that this case will settle.
