YES!!!! SUPREME COURT RULES TRUMP’S TARIFFS ARE *ILLEGAL*!
While *Congress* has the power to impose tariffs, Trump has been claiming that under the International Emergency Economic Powers Act (IEEPA) he had the power to impose tariffs without Congress’ approval.
Now, in a *170-page*, 6-3 opinion (included for Notes from the Front members), written by Chief Justice Roberts, the Court said “Not so fast, buddy-boy.” (Justices Kavanaugh, Thomas and Alito were the dissenters.)
Well, actually it said, and I quote:
“IEEPA contains no reference to tariffs or duties. The Government points to no statute in which Congress used the word ‘regulate’ to authorize taxation. And until now no President has read IEEPA to confer such power. We claim no special competence in matters of economics or foreign affairs. We claim only, as we must, the limited role assigned to us by Article III of the Constitution. Fulfilling that role, we hold that IEEPA does not authorize the President to impose tariffs.”
I have felt like I’ve been screaming into the void, pointing out every time people incorrectly say “But the Supreme Court is in Trump’s pocket” that *no*, they are *not* in Trump’s pocket. And I’m sure this won’t shut some of them up. But it should.
