WOOHOO!! COURT ORDERS DHS TO *REINSTATE* THE STATUS OF NEARLY 1MILLION IMMIGRANTS WHOSE STATUS TRUMP HAD TERMINATED!
This order and *judgement* is so freaking fantastic!! The Biden administration developed a program, and a corresponding app, called CBP One. This was for people seeking asylum coming through Mexico, at the Texas / Mexico border. The CBP One program primarily served people from Brazil, Chile, Colombia, Cuba, El Salvador, Haiti, Honduras, Mexico, Venezuela, and also Russia. (*Yes, I spell it ‘judgement’, which is perfectly acceptable, if you have the urge to ‘correct’ me… don’t.)
People wanting to immigrate into the United States through the Texas / Mexico border could register through CBP One, and schedule intake appointments. Under CBP One, if they qualified to apply to immigrate, they were paroled into the United States while their applications were being processed .
U.S. Citizenship and Immigration Services (USCIS) explains that parole allows them “to leave an inspection facility freely so that, although they are not admitted to the United States, they are permitted to be physically present in the United States… The paroled alien is treated as an applicant for admission.” Parole is not the same as a visa or other legal status, it’s basically “you are a guest in our country, and you are legally in our country while we process your application and decide what to do with you.”
The typical parole period was two years, during which they could apply to be allowed to work, and for other benefits.
Last April (April 2025) DHS sent out a letter to over 900,000 people *terminating* their parole. In fact, it was April 11, which I know because I just spent a fair amount of time trying to find a copy of the actual letter (which I did, and which I’m including for Notes from the Front members).
It’s not only awful in what it says, but in the *way* that it says it! The *very first sentence* is:
“It is time for you to leave the United States.”
This was sent to people here *lawfully*, who had done it the right way, who were here seeking *asylum*, and then they get this abrupt directive out of the blue?? WTAF??
What’s more, it gave them *one week’s notice*! From the moment the notice was mailed (not received, mailed), their parole was being terminated 7 days later.
It then went on to encourage them to self-deport, and to report their self-deporting through the same app through which they were encouraged to apply!
And some people didn’t even get the notice; one day they just discovered that their parole had been terminated!
So a few months later, in August of 2025, this lawsuit was filed. And not just for the plaintiffs – they requested that a class be certified for a class action lawsuit. And they got it!
And now there is a decision, and order (included in full for Notes from the Front members), *and a judgement* (ditto)! And that order says, in part:
“The terminations of class members’ parole statuses announced
by the April 2025 Termination Email are VACATED” and “Defendants are ordered to return class members to the parole status that they held prior to the April 2025 Termination Email.”
Oh yeah, and also “The Court certifies the following class: All individuals who (i) scheduled their appointments for entry to the United States using the CBP One app; (ii) were paroled into the United States between May 16, 2023 and January 19, 2025; (iii) had their parole terminated in April 2025 pursuant to an email substantially similar to the one reproduced at paragraph 38 of the Complaint without any further explanation; and (iv) remain in the United States.”
