UPDATE ON ABREGO GARCIA CASE
In case you’ve been wondering what is going on with Kilmar Abrego Garcia’s case (and I know that some of you have been, because you’ve been asking me), first, to not keep you in suspense, there has been no new *major* development in his cases. The last big development was in his case against DHS, when on February 17th Judge Xinix expressly forbade ICE from taking him back into custody. However, in the *other* case, United States v. Garcia, there is a *minor* development, but I think that it speaks volumes about the state of his life. Note that a fair amount of what is going on in that case is filed under seal. And at least some of that is actually at Abrego Garcia’s request, to protect his privacy and that of his family.
So it is with the most recent activity; however while the ultimate order is sealed, his *request* (motion) for that order is what I think speaks volumes.
While I am including the full thing for Notes from the Front members, it’s only one page (and yet speaks so loudly) so here is the meat of it:
“Kilmar Armando Abrego Garcia respectfully requests leave to file under seal his March 5, 2026 Motion for Modification of Conditions of Release. To protect Mr. Abrego’s privacy (and the privacy of fellow churchgoers), we file this document, which includes the name and address of Mr. Abrego’s church, as well as information about church services that might allow an individual to identify it even without the name and address, under seal.”
Just two sentences, and yet they say so much. He is still out in the world, but he is hardly free. In order to even go to church he has to file a motion with the Court to modify the conditions of his release, letting the Court know where he is going to go to church.
Second, he has to ask for it to be filed under seal, so that where he goes to church isn’t a matter of public record, because of course he is now a national icon, and likely also a national target.
Finally, the very last sentence is “The government does not oppose Mr. Abrego’s request to file under seal.”
Because the government has to approve (or challenge) pretty much every action that he takes.
So far I don’t see the next hearing or trial on the calendar, but you can be sure I’ll keep you updated when I do.
