PEOPLE HAVE BEEN ASKING ME ABOUT EPSTEIN’S NON-PROSECUTION AGREEMENT – I HAVE IT AND HERE’S AN EXPLANATION OF THE NPA PLUS ACOSTA’S TESTIMONY ABOUT IT
Following my ‘Epstein had a sex bed in his work release vehicle” article earlier this week (you can see that here: https://www.facebook.com/share/p/1DRY3R5ePA/ ) a lot of people have been asking me about Epstein’s non-prosecution agreement (NPA), which of course is what made it possible for him avoid federal criminal charges, and instead be prosecuted by the state of Florida. Once he was in jail in Florida he applied to the Florida sheriff for work release, and was granted work release and a sex bed in his Suburban. (Ok, he wasn’t really *granted* the sex bed, but he had one in the Suburban with which he commuted to “work” every day while on work release.)
So here’s the deal: basically the NPA said that the feds would not prosecute Epstein so long as he abided by the conditions of the Florida prosecution.
But wait! There’s more!
The NPA *also* said that the U.S. agreed not to charge Epstein’s “co-conspirators”, and that while it *names* four people (Kellen, Ross, Groff, and Marchikova), it also said that the agreement included *but was not limited* to those four people. Here’s that paragraph:
“In consideration of Epstein’s agreement to plead guilty and to provide compensation in the manner described above, if Epstein successfully fulfills all of the terms and conditions of this agreement, the United States also agrees that it will not institute any criminal charges against any potential co-conspirators of Epstein, including but not limited to Sarah Kellen, Adriana Ross, Lesley Groff, or Nadia Marchikova.”
This is, of course, one of the things that Maxwell tried and is still trying to use to have her own conviction tossed, arguing that the NPA covers her as one of the “potential co-conspirators”. The government successfully argued that the NPA did *not* exempt her from the indictment and prosecution that landed her in jail because the NPA was executed in and binding on the District of Florida and her prosecution is in the District of New York. Her appeal is before the Supreme Court right now, arguing that the NPA says “the United States also agrees that it will not institute any criminal charges against any potential co-conspirators,” and so it should be binding across the country on *all* the districts.

Now, you may be wondering what on earth would ever persuade the U.S. Attorney on the case at the time, Alex Acosta, to cede the prosecution of Jeffrey Epstein to the state of Florida. And there have been a whole lot of conspiracy theories about that. And Congress had the exact same question. So just *7 months* ago, in September, they had Alex Acosta testify about that, and that *172*-page transcript is included for Notes from the Front members as well.
By the way, contrary to popular lore, Pam Bondi was *not* the Attorney General of Florida at the time, Bill McCollum was. Bondi didn’t take over as Attorney General in Florida until 2011, well after Epstein had served his time in Florida.
