On at least 23 occasions, federal agents in Minnesota detained people solely on the basis of their race during Operation Metro Surge. That’s according to Federal Judge Eric Tostrud. Judge Tostrud (a Trump appointee) wrote that the plaintiffs made “a clear showing” that the federal government adopted a policy authorizing agents to conduct investigatory stops based on race or ethnicity without reasonable suspicion. He also found the government adopted a policy to arrest people without warrants or probable cause.

Tostrud reviewed 34 cases involving American citizens and immigrants, most of whom were in the country legally, who were victims of racial profiling. He found that ICE officers made stops based on “reasonable evidence” in five of those cases meaning the racial profiling finding applied to the remaining cases.

One plaintiff, Mahamed Eydarus, a 25-year-old U.S. citizen of Somali descent, was shoveling snow from a parking spot in Minneapolis when more than half a dozen armed men in unmarked cars demanded he prove he was “not illegal.” Agents asked his mother to remove her niqab and questioned why she was speaking a “foreign language.” They were detained for about half an hour.
