73 CONGRESSIONAL REPRESENTATIVES CALLING FOR THE 25TH AMENDMENT TO BE INVOKED AGAINST TRUMP
73 members of Congress, so far, are calling for the 25th Amendment to be invoked against Trump. There are also dozens of other state officials, and former federal officials, and even some prominent Republicans, calling for him to be removed.
As a reminder, the 25th Amendment details, among other things, how a president can be removed from office for being “unable to discharge the powers and duties of his office”. If that happens the vice president assumes the duties of the president. However, it has never, in the entire history of our country, come to pass, and it’s unlikely to now. But that said, it’s a *great* thermometer for taking the temperature of our country right now, one which Republicans can’t afford to ignore.
Here’s how involuntary removal under the 25th Amendment gets enacted. The vice president and a majority of the cabinet (there are 15 cabinet members) have to trigger it by transmitting to Congress that they are invoking the 25th Amendment because the president is no longer able to carry out his duties. (The Constitution also provides for an alternate body, in lieu of the cabinet; it’s a majority of the cabinet or “such other body as Congress may by law provide”, however Congress has never provided such a body, so the cabinet it is.)
The president can then revoke it by transmitting to Congress that he is now able to perform his duties again, at which point the VP and a majority of the cabinet can challenge the president taking the reins again. If that happens then 2/3s of both the House *and* the Senate must vote to side with the VP to keep the president from regaining office. Otherwise the president is back in the saddle again.
